Pursuant to section 91 para 1 et seq. in connection with section 93 para 2 Austrian Stock Exchange Act and section 5 para 3 of the Transparency Ordinance (TransVO) Warimpex Finanz- und Beteiligungs Aktiengesellschaft ("Warimpex") hereby gives note that on 27.08.2010 Aviva Powszechne Towarzystwo Emerytalne Aviva BZ WBK SA, the management company over the open-ended pension fund Aviva Otwarty Fundusz Emerytalny Aviva BZ WBK shared the information, that Aviva Otwarty Fundusz Emerytalny Aviva BZ WBK has acquired 319,042 voting shares and, as of 23.08.2010 holds 2,724,588 voting shares of a total of 54,000,000 voting shares, and it therefore holds 5.05% of Warimpex' share capital, which means that the thresholds specified in section 91 of the Austrian Stock Exchange Act have been exceeded.

Prior to settlement of the transaction indicated above, as at 20.08.2010, Aviva Otwarty Fundusz Emerytalny Aviva BZ WBK held 2,405,546 voting shares representing 4.45% of Warimpex' share capital.
