iQ Power Licensing AG (ISIN: CH0268536338; WKN/Security Number: A14M1C; Symbol: IQL) a developer and marketer of technologies for environmentally friendly and technologically innovative starter batteries for motor vehicles and licenses in these technologies, announces the successful defense of the iQ Power trademark in the Peoples' Republic of China.
Challenge
iQ Power management learned through its legal surveillance network of a local battery company that had applied to the Chinese federal patent and trademark office to use the same name for their batteries. According to Chinese regulations, the burden of proof for trademark defense lies with the company owning the trademark and not the challenger. The deciding factor for a successful defense is proof of use in daily business in China.
iQ Power has been reluctant to aggressively market in China due to the Chinese reputation for product piracy. Due to the low volume of activity, it was a major challenge to convince the government officials to confirm the validity of the trademark.
Successful Defense
Two key elements were used by iQ Power to prove the claim: First and foremost, iQ Power was able to use the sales of batteries with iQ Power logo in southern China through the Factory Warehouse of Discover Energy to show brand awareness. Secondly, iQ Power was able to show significant business activity from the extensive tooling program at the plastic injection molding company near Beijing, where numerous plastic part mold sets with the iQ Power logo are stored.
Intellectual Property Strategy is key to success
iQ Power has, over the years, spent a great deal of time and money to build up legal protection for the iQ Power brand and intellectual property. As the iQ Power technology gains momentum in the market place, the chances of copycats and brand theft increase.
As shown in this dispute, the attention to providing adequate protection is now paying off, even in countries not known for strong laws on intellectual property rights. iQ Power will continue to vigilantly monitor worldwide markets to defend its intellectual property and brand.
